An Advanced Contract Award Notice (ACAN) must be prepared in both official languages. Below is a model that must be used by contracting officers for the preparation of an ACAN. The blocks include guidance for its use as well as examples for some of the items listed. 1. Advance Contract Award Notice (ACAN)
An ACAN is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier.
2. Definition of the requirement
The Department of Public Services and Procurement Canada has a requirement for the supply of two (2) microfiche/microfilm scanners, ScanPro 3000.
3. Criteria for assessment of the Statement of Capabilities (Minimum Essential Requirements)
Any interested supplier must demonstrate by way of a statement of capabilities that its product meets the following requirements: a. Hardware and Software compatible with Windows 7 and 10 (32 and 64 bits) b. Scanning modes available (but not limited to): grayscale 8-bit, bitonal c. Output images file format (but not limited) to: JPEG; JPEG 2000; PDF; PDF/A; TIFF native; single and multi-page d. Minimum optical output resolution of 150 to 2000 dpi with a preferred optical resolution of 600 dpi or better e. Optical zoom minimum 7X to 100X f. Handle roll films, fiches and jackets g. Automatic image adjustment (brightness, crop, straighten) h. Included software must provide basic image manipulation tool (cropping, rotating, brightness adjustment, output format selection) i. Maximum power draw: 120 V, 15 Amp
In addition, any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements:
a. The scanners must be brand new machine built from new parts and still serviceable. b. The scanners must have an optional 2-years of on-site warranty beyond the initial 1 year period, for a total potential period of 3 years. c. The following maintenance must be provided by the contractor: Monday Friday 7am to 5pm: On-site Maintenance Service, 15 minute call-response time, technician on-site within 4 hours. Saturday and Sunday: Telephone support, 15 minute call-response time, 2 hours to diagnose or repair problem, technician on-site before 8:30am next business day. d. The contractor must provide on-site set up, training and assistance customizing software.
e. The contractor must provide the following on-site training in Matane, Quebec as scheduled with PSPC: 1. IT Operations training, provided in French and English, including, but not limited to preventive maintenance, monitoring, troubleshooting, and performance tuning 2. Basic maintenance training, provided in French or English (as required by the client), including, but not limited to technician on the various type of maintenance, replacement of worn parts and customer service via telephone. 3. Operations training, provided in French and English, including, but not limited to user training on the various Software Solution functions. f. The contractor must provide on-site technical resource(s) in Matane at the IRGOD facility to perform the product installation. g. The following documentation must be delivered with the scanners in hard copy and soft/electronic copies: 1. A complete set of documentation including all publications pertaining to technical specifications, software related documentation installation requirements, configuration, parts manual, administration and operating instructions; 2. Bilingual (French and English) non-technical end user operational documentation related to the day-to-day operations. h. The scanners components must execute on and support the following Operating Systems, including, but not limited to Microsoft Windows 7 and 10 in both 32 and 64 bits. i. The contractor must provide basic software to manage the scanner 4. Applicability of the trade agreement(s) to the procurement
This procurement is subject to the following trade agreement(s):
o Canadian Free Trade Agreement (CFTA) o North American Free Trade Agreement (NAFTA)
5. Justification for the Pre-Identified Supplier
Nimble Information Strategies Inc. is the sole source supplier for Canada for e-ImageData Corp ScanPro 3000 Microfilm Scanner and is able to meet the service requirements of Public Services and Procurement Canada. 6. Government Contracts Regulations Exception
The following exception to the Government Contracts Regulations is invoked for this procurement under subsection 6(d) - "only one entity is capable of performing the work".
7. Exclusions and/or Limited Tendering Reasons
The following exclusions and/or limited tendering reasons are invoked under the section of the trade agreements specified:
Canadian Free Trade Agreement (CFTA) Article 513 Item 3b. Where the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute goods or services exist.
North American Free Trade Agreement (NAFTA) Article 1016 Item 2b.
Where for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons and the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists.
8. Delivery date
The product must be delivered on or before March 31, 2020.

Cost estimate of the proposed contract
The estimated value of the contract is $27,000 - $32,000.00 (GST/HST extra).

Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements. 12.Closing date for a submission of a statement of capabilities
The closing date and time for accepting statements of capabilities is March 10, 2020 at 2:00 p.m. PST.

You are hereby notified that the government intends to negotiate with one firm only as identified above. Should you have any questions concerning this requirement, contact the contracting officer identified above.
An Advance Contract Award Notice (ACAN) allows departments and agencies to post a notice, for no less than fifteen (15) calendar days, indicating to the supplier community that it intends to award a good, service or construction contract to a pre-identified contractor. If no other supplier submits, on or before the closing date, a Statement of Capabilities that meets the requirements set out in the ACAN, the contracting authority may then proceed with the award.
However, should a Statement of Capabilities be found to meet the requirements set out in the ACAN, then the contracting authority will proceed to a full tendering process.
Suppliers who consider themselves fully qualified and available to provide the services/goods described herein, may submit a statement of capabilities in writing to the contact person identified in this Notice on or before the closing date of this Notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
The PWGSC file number, the contracting officer's name and the closing date of the ACAN must appear on the outside of the envelope in block letters or, in the case of a facsimile transmission, on the covering page.
The Crown retains the right to negotiate with suppliers on any procurement.
