PROJECT TITLE: 5G Phased-Array Antennas (27.5 GHz to 30 GHz)
The Communications Research Centre (CRC) Canada is a branch of the Spectrum and Telecommunications Sector (STS), the portion of the Department of Innovation, Science and Economic Development Canada (ISED) that regulates the radio spectrum in Canada on behalf of the Government of Canada.
CRC has a requirement for a contract to obtain two (2) 64-element 5G phased-array antennas (27.5 GHz to 30 GHz). These antennas are required to characterize millimetre-wave (mm-wave) frequency bands as well as to test and demonstrate 5G mobile wireless communications technologies. The purpose of this Advance Contract Award Notice (ACAN) is to signal the governments intention to award a contract for these services to the following pre-selected supplier:

Before awarding a contract, however, the government provides other suppliers with the opportunity to demonstrate that they are capable of satisfying the requirements set out in this Notice, by submitting a Statement of Capabilities during the fifteen calendar day posting period.
If other potential suppliers submit Statements of Capabilities during the fifteen calendar day posting period that meet the requirements set out in the ACAN, the government will proceed to a full tendering process on either the governments electronic tendering service (buyandsell.gc.ca) or through traditional means, in order to award the contract.
If no other supplier submits, on or before the closing date, a statement of capabilities meeting the requirements set out in the ACAN, a contract will be awarded to the pre-selected supplier, as referenced above.
BACKGROUND:
STS is actively engaged in current worldwide efforts to develop and deploy more powerful fifth-generation (5G) wireless technology, including increasing the spectrum supply by opening up new bands at mm-wave frequencies, developing effective means to measure the radio spectrum, and understanding the implications of 5G technology for spectrum management. The current proposal is related to compatibility with new 5G telecommunications standards and technologies operating in mm-wave bands, in particular the 27.5 GHz to 30 GHz band that is slated to be auctioned in 2021.
OBJECTIVE:
CRC is expanding its 5G research. We have test equipment and testbeds that work in the 27.5 GHz to 30 GHz band. Beamforming is an important 5G technology that is called for in standards and enables directional signal transmission and reception. CRC is currently lacking the equipment needed to do beamforming in this band. Purchasing these commercially available 5G phased-array antennas will augment our testbeds and equipment to be able to support beamforming so that CRC can do innovative R&D and support the mission and mandate of STS.
SCOPE OF WORK:
To provide two (2) 64-element 5G phased-array antennas that meet or exceed the specifications in Annex A.
DELIVERABLES:
The contractor must provide
1. Two (2) 64-element 5G phased-array antennas. 2. Two (2) power supplies unless integrated into antenna. 3. Software and drivers to control the antenna.
MINIMUM ESSENTIAL QUALIFICATIONS:
To fulfill the requirements of the contract, the person or firm must meet the following minimum requirements:
1. The interested supplier must be able to provide a specification sheet for their commercially available product that meets or exceeds the specifications outlined in Annex A; 2. The interested supplier must prove that it has had at least two (2) years of ISO 9001 certification.
GOVERNMENT OF CANADA REGULATIONS EXCEPTION:
The Treasury Boards Government Contract Regulations, Part 10.2.1 Section 6 states there are four exceptions that permit the contracting authority to set aside the requirement to solicit bids. The exception for related to this ACAN includes: d. only one supplier person or firm is capable of performing the contract.
JUSTIFICATION FOR THE PRE-SELECTED SUPPLIER:
CRC has conducted an extensive search of possible suppliers of antennas of this type. There is a very limited supplier market. Only one company was identified and contacted. Richardson Electronics is the only supplier that had a product of this type and met the Minimum Requirements.
Applicability of the trade agreement(s) to the procurement
This requirement is subject to the North American Free Trade Agreement (NAFTA), and the Agreement on Internal Trade (AIT) and the Bilateral Trade Agreements.
Government Contracts Regulations Exception(s)
Government Contract Regulations applies as only one person is capable of performing the work (Supply Manual Chapter 3 - 3.15).
Limited tendering procedures in accordance with AIT, NAFTA, and the Supply Manual (SM), Chapter 3, Annex 3.2 where:
- for works of art, or for reasons connected with the protection of patents, copyrights or other exclusive rights, or proprietary information or where there is an absence of competition for technical reasons, the goods or services can be supplied only by a particular supplier and no reasonable alternative or substitute exists; (CAP Code 71).
Ownership of Intellectual Property:
Canada intends to retain ownership of any Foreground Intellectual Property arising from the measurements and data created using the 5G phased-array antennas.
Canada reserves the right to share the data and research with other legal entities to further its research.
The data will be shared for the sole purpose of executing work under a legal agreement that prevents the legal entity from using the data for any other purpose.
Requested delivery date:
The equipment must be delivered on or before March 31, 2020.
Cost estimate of the proposed Contract:
The estimated value of the contract is $100K USD.

Suppliers' right to submit a statement of capabilities:
Suppliers who consider themselves fully qualified and available to provide the goods, services or construction services described in the ACAN may submit a statement of capabilities in writing to the contact person identified in this notice on or before the closing date of this notice. The statement of capabilities must clearly demonstrate how the supplier meets the advertised requirements.
Responses received on or before the closing date will be considered solely for the purpose of deciding whether or not to conduct a competitive procurement. Information provided will be used by the Crown for technical evaluation purposes only and will not be construed as a proposal. The submitted written response must provide sufficient evidence (e.g. specifications, technical data, drawings or any other proof) that clearly demonstrates that the proposed product is capable of fulfilling this requirement.
Suppliers that have submitted a response will be notified in writing of CRCs decision whether to continue with the aforementioned procurement or to compete the requirement.
